AGREEMENT
BETWEEN THE REPUBLIC OF KAZAKHSTAN AND
THE HASHEMITE KINGDOM OF JORDAN
ON THE TRANSFER OF SENTENCED PERSONS

The Republic of Kazakhstan and the Hashemite Kingdom of Jordan, hereinafter referred to as the «Parties»,
Desiring to promote an effective cooperation between both Parties on the transfer of the sentenced persons for the purpose of facilitating their rehabilitation and social reintegration,
On the basis of the principles of national security and non-interference in the internal affairs of the Parties,
Considering that this purpose can be achieved through the conclusion of the bilateral Agreement establishing the possibility for the sentenced persons to serve their sentence within their social environment,
Have agreed as follows:
ARTICLE 1
GENERAL PRINCIPLES
1. The Parties undertake to mutually grant according to the provisions of this Agreement the largest possible cooperation in the field of the transfer of the sentenced persons.
2. A sentenced person on the territory of any of the Parties may be transferred, according to the provisions of this Agreement, to the territory of the other Party, in order to serve the imposed sentence. To this effect, the sentenced person or his/her legal representative can express, either to the Sentencing State, or to the Executing State, his/her written consent to be transferred to the Executing State.
3. The transfer may be requested either by the Sentencing State, or by the Executing State.
ARTICLE 2
DEFINITIONS
For the purpose of this Agreement:
a) «sentenced person» means any person deprived of his/her liberty for being sentenced by a court in the territory of either Party;
b) «sentence» means any final punishment involving deprivation of liberty ordered by a court as a result of the criminal offence;
c) «Sentencing State» means the Party in which a sentence has been imposed on a person to be transferred;
d) «Executing State» means the state to which the sentenced person has been or may be transferred in order to serve his/her sentence and supervising the execution of the punishment;
e) «citizen» means a person bearing the nationality of one of the Parties.
