Experience

Aidar specialises in corporate, financial, commercial and investment rights in the fields of natural resources, power and banking. He actively participated in the development of the Kazakh legislation on the use of minerals, ecology, power and the protection of investments.

His clients include Shell Kazakhstan Development, Maersk Oil Kazakhstan, Nations Energy, ONGC Videsh, Oman Oil, Petrom, BMB Munai, Kazakhmys, SUAL, KazZink, Halliburton, Weatherford, EBRD, Kazkommertsbank, Halyk Bank, Eurasian Bank, Standard Chartered Bank, Procter & Gamble.

Education

In 1995 Aidar received a distinction from the law faculty of the Kazakh State University. He then undertook postgraduate study at the Institute for Government and Law within the Kazakh National Academy of Science.

From 1997 to 1998, Aidar worked for the State committee of the Republic Kazakhstan in the department of investments where he was a manager responsible for answering legal questions. He analysed legal position of more than 300 of the largest investment contracts, as well actively participated in the formation of legislation on protection and encouragement of investments.

From 1999 to 2001 Aidar trained at leading international law firms in Great Britain and the USA. He has also visited numerous conferences and training events in the field of management, especially management of legal firms, both in the Europe and in Kazakhstan.

Aidar is an active participant and speaker at many international conferences in the field of investment protection, oil and gas and mining industries, corporate management and financing.

Experience

Shaimerden Chikanayev is a Partner and the Head of Finance and Securities Department at GRATA Law Firm.

Shaimerden joined GRATA in September 2009. Previously, he worked for one year as a Lawyer in an international law firm Dewey & LeBoeuf in Almaty, two years as a Lawyer at the Legal Department of the European Bank for Reconstruction and Development in London, and three years as a Lawyer, then as a Senior Lawyer at GRATA’s Astana office.

Shaimerden specialises in financial law and securities, bankruptcy and restructuring, as well as Mergers and Acquisitions.

Shaimerden advised on the following deals:

· acted as a Kazakh Lawyer for CNPC on its $3.3 billion acquisition of a 50 percent interest (together with KazMunayGas) of MangystanMunayGas, a leading independent Kazakh oil producer and refiner;

· advised foreign creditors on BTA Bank and Alliance Bank restructuring and general insolvency proceedings in Kazakhstan;

· acted as a Kazakh Lawyer for JSC National Company KazMunayGas (KMG) and its Dutch finance subsidiary, KazMunaiGaz Finance Sub B.V., in connection with an update of their Global Medium Term Note Programme which concerned an increase in size of the Programme to $5 billion and issuance of $1.25 billion 11.75% notes by 2015, guaranteed by JSC National Company KazMunayGas;

· advised an international bank on $ 90 million secured loan to a Kazakh bank;

· advised an international bank on $ 135 million syndicated loan to a Kazakh company to extend construction of a fibre optic communications network along the railway tracks of Kazakhstan Temir Zholy - Kazakhstan’s National Railways Company.

Experience

Bolat Miyatov is a Corporate Partner at GRATA Law Firm, Almaty, and the Head of the Corporate and Labour Law groups.

Bolat has extensive experience in the banking and finance sector, where he has advised on matters concerning debt capital markets, cross-border financing transactions, trade finance, syndicated loans and securities transactions. He has also significant experience in corporate secretary and compliance matters, Kazakh corporate law and M&A transactions.

Bolat joined GRATA in March 2009 and currently focuses on M&A deals and anti-monopoly issues. Major deals that he has advised on include acting for the International Finance Corporation, a member of the World Bank group, dealing with equity investment in Bank CenterCredit (Kazakhstan) and advising Punjab National Bank, the second major state-owned bank of India, on its recent acquisition of Dana Bank (Kazakhstan).

Bolat regularly advises Kazakh and foreign clients on issues of corporate governance and employment law, including matters of employment for key managerial positions.

Bolat speaks Kazakh, English and Russian fluently.

Education

Bolat graduated from the Kazakh Humanitarian Law University (Almaty), with a diploma in Law with a distinction, in 2003. Then he successfully undertook securities market courses to receive a Kazakh broker/dealer qualification categories.

Experience

Prior to joining GRATA Law Firm, Yerzhan worked in the Kazakhstan Investment Fund group, in a major Kazak Development Company Capital Partners, and as an Associate of Baker & McKenzie International Law Firm. Yerzhan has extensive experience in the areas of Real Estate & Construction, Subsoil Use and Infrastructure. Yerzhan acted as a Consultant on a number of large infrastructure projects realized within the last several years in Kazakhstan, including work as a head of the legal department working on the Medeu and Chimbulak mountain resorts reconstruction projects realised within the frameworks of Asian Games 2011.

Yerzhan's practice is focused on subsoil use, real estate & construction, contract law and infrastructural projects. Yerzhan is an author of a number of articles and reviews relating to real estate issues, construction and environmental protection in Kazakhstan, including an overview of Kazakhenvironmental legal framework for PLC Cross-border Environment Handbook 2010/11, and Kazakh climate change regulations for BNA Environment Reporter.

He speaks English, Russian and Kazakh.

Education

Yerzhan graduated with high honors from Kazakh State Law University, International Law Faculty in 2004.

 

Tax Law

Experience

Almat has extensive experience in tax, transfer pricing, investment, oil and gas sectors as well as in the field of litigation.

Almat's practice is focussed on tax issues encountered by all kinds of companies active in Kazakhstan such as oil industry companies, as well as financial institutions. He acts as a regular corporate adviser to a number of high profile international and Kazakh clients.

Almat is a member of the Kazak Petroleum Lawyers' Association and is the authorised representative of the Kazakh Taxpayers' Association.

Almat speaks fluent Russian and English.

Education

Almat graduated from the Kazakh State University of Law with a distinction in 2004. He then undertook a postgraduate course in Taxation, and is currently studying at the Kazakh Humanitarian University.

He has taken part in numerous training courses on both European and Kazakh law. These include EU law training, which was sponsored by TACIS, and training on Transfer Pricing provided by the Kazakh Ministry of Finance.

 

Customs Law

Experience

At present, Assel is a Partner and the Head of the Tax Law Department at GRATA Law Firm, having joined the firm in 2006.

Previously, Assel worked in the Almaty City Tax Authority as a Senior Tax Inspector in charge of legal support of the Tax Committee, including representation of its interests in court.

Assel specialises in subsurface use taxation, corporate and international taxes and customs procedures, including responsibility for tax and customs crimes.

In 2004, Assel was declared the best officer of the Almaty City Tax Committee and in 2006, the highest performing employee of GRATA Law Firm.

Assel speaks Kazakh, Russian and English.

Education

Assel is an experienced Kazakh lawyer. In 2003, she graduated from the Kazakh Humanitarian and Law Institute (Almaty, Kazakhstan) with a Bachelor’s degree. In 2009, she received a Master’s Degree in Law from City University (London, UK).

In September 2009, Assel underwent training with the Tax Department of Eversheds International Law Firm (London, UK).
